WIN WITH KINGSMILL PRIZE PROMOTION TERMS AND CONDITIONS

1. By entering the Promotion, entrants confirm that they have read and agree to be bound by these terms and conditions. Internet access required.

2. Promoter: The Promoter is Allied Bakeries, a division of ABF Grain Products Limited, company number 00079590, registered address: Weston Centre, 10 Grosvenor Street, London W1K 4QY, United Kingdom © 2020 Allied Bakeries. (the “Promoter”).

3. Eligibility: The Promotion is open to UK (England, Wales, Scotland and Northern Ireland) residents aged 18 years or over, excluding employees of the Promoter, associated agents, or anyone else professionally connected with the Promotion and their immediate families (spouse, parent, child, sibling, grandparent and/or "step" family living in the same household).

4. Promotion Timings:

a. The Main Prize Promotion will begin at 09:00 Monday 5th October 2020 and will end at 23:59 on Monday 7th December 2020 (the “Main Prize Promotion Period”).

b. The Grand Prize Promotion will begin at 09:00 Monday 5th October 2020 and will end at 23:59 Sunday 13th December 2020 (the “Grand Prize Promotion Period”)

c. All valid entries into the Main Prize Promotion will also be entered into the Grand Prize Promotion. The draw for the Grand Prize Promotion will take place on Monday 14th December 2020.

d. Entries received outside of the Main Prize Promotion Period will not be accepted and you will not be able to enter into the Main Prize Promotion. However, participants who enter after the Main Prize Promotion Period but before the expiry of the Grand Prize Promotion Period, will still be entered into the Grand Prize Promotion.

5. How To Enter – Great Britain (England, Scotland, Wales):

a. To enter into the Promotion you must:

i. purchase a promotional loaf of Kingsmill Soft White Medium or Thick 800g.

ii. Go to Kingsmillwin.com.

iii. Enter your residential house number, post code and valid email address.

iv. Enter the first four letters/numbers found on the ‘best before’ tag plus the ‘best before’ date also found on the ‘best before’ tag (e.g. RY39 07).

b. All participants will be automatically entered once into the Grand Prize Promotion. Participants that do not wish to be entered into the Grand Prize Promotion, can opt out by emailing here.

c. If you enter after the expiry of the Main Prize Promotion Period but before the expiry of the Grand Prize Promotion Period, you will only be entered into the Grand Prize Promotion.

d. Only one (1) entry is permitted per household per week (Monday to Sunday). For the avoidance of doubt, only one entry (based on residential address and email address) will be accepted, and a household can use this only once to enter a maximum of once per week during the Main Prize Promotion Period or the Grand Prize Promotion Period (if the Main Prize Promotion Period has expired).

e. Sharing of packaging is not permitted. Any entrant or household using multiple email addresses, multiple postal addresses or multiple names to access the Promotion will be disqualified and any prize will be void. The Promoter reserves the right to determine, in its sole and absolute discretion, whether a participant or household has already submitted an entry and to disqualify any subsequent entries or prize claims.

f. Only valid codes will be accepted.

g. Entrants must have internet access to enter the Promotion. The entrant is reminded to get the owner's permission before using a computer, device and/or internet-access which is not owned or paid for by the entrant to enter the Promotion. The Promoter will not be liable for any internet or mobile connection or other charges incurred in entering the Promotion.

h. Proof of sending will not be accepted as proof of delivery or receipt of entry. Incomplete, illegal, misdirected or entries received outside of the applicable Promotion Period will not be accepted and you will not be entered into the Promotion.

6. How To Enter - Northern Ireland:

a. To enter into the Promotion you must email here with your full name and residential address and an entry will be made on your behalf during the Main Prize Promotion Period or the Grand Prize Promotion Period (if the Main Prize Promotion Period has expired). Please allow 2 working days for your entry to be processed.

b. All participants will be entered once into the Grand Prize Promotion. Participants that do not wish to be entered into the Grand Prize Promotion, can opt out by emailing here.

c. Only one (1) entry is permitted per household per week (Monday to Sunday). For the avoidance of doubt, only one entry (based on residential address and email address) will be accepted, during the Main Prize Promotion Period or the Grand Prize Promotion Period (if the Main Prize Promotion Period has expired).

d. Proof of sending will not be accepted as proof of delivery or receipt of entry. Incomplete, illegal, misdirected or entries received outside of the applicable Promotion Period will not be accepted and you will not be entered into the Promotion.

e. Prizes won via the NI free-entry route will only be dispatched to residents of Northern Ireland.

f. Any entrant or household using the free entry route to access the Promotion that does not reside in Northern Ireland will be disqualified and any prize will be void.

7. Main Prize Promotion Details:

a. The Promoter is giving away 850 cash prizes during the Main Prize Promotion Period. The 850 cash prizes will be given away as follows:

b. All prizes are non-transferable and non-exchangeable.

c. A household can only win one cash prize during the Main Prize Promotion Period.

d. The prizes are allocated via winning moments. If you enter during a winning moment, you will win a prize pre-allocated to that moment by an independent third party. In the event that no one enters at the winning moment, that prize will remain available until the next entry. All of the prizes will be won.

e. Winners will be notified immediately on screen and see which prize they have been allocated and will be required to provide remaining residential postal address details on screen.

f. Each cash winner will be contacted within 7 days via the email address provided at the point of entry, and will be asked to provide proof of residential postal address provided at the point of entry and proof of name and age with valid ID, and to confirm how they would like to receive their cash prize. Business or work addresses will not be accepted. Only official documents can be accepted as proof of address (driving licence, utility bill less than three months old or bank statement, for example). Out of date proof of identity or address will not be accepted. A mobile phone bill will not be accepted as proof of address. Please note we can only send and receive emails to and from the address given at the point of entry.

g. If any winner declines a prize or fails to respond within 7 days or is unable to provide the correct proofs, they forfeit any right to the prize.

h. The cash prize will be sent within 4 weeks of verification either via cheque to the address supplied at the point of entry; via bank transfer to a UK Sterling bank account; or sent by SMS text to winner’s mobile phone that can then be used to instantly collect the cash from over 17,000 participating cash machines across the UK. Neither bank account details nor bank card is required to collect cash via the cash machine, just the unique details and PIN code included in the text message.

i. Promoter cannot guarantee that cash prizes will be delivered before Christmas.

8. Grand Prize Promotion Details:

a. The Promoter is offering 12 further cash prizes in the Grand Prize Promotion:

3 x £1,500

5 x £1,000

b. The Grand Prize draw will take place on 14th December 2020 from all eligible entries received during the Grand Prize Promotion Period.

c. Entrants will only be entered once into the Grand Prize Promotion regardless of number of individual entries made during the Main Prize Promotion Period.

d. The 12 Grand Prize winners will be selected by a random computer generator and notified by Prizeology Limited (on behalf of the Promoter) via email using the contact details provided with their entry within 7 days of selection and will be asked to provide proof of residential postal address, and name and age with valid ID and confirm how they would like to receive their cash prize. Please note we can only send and receive emails to and from the address given at the point of entry.

e. If a Grand Prize winner does not respond to the email notification within the initial 7 days, they will be emailed again and given a further 7 days to respond. If contact cannot be made or if a Grand Prize winner does not respond within these 14 days providing the required information, then the Grand Prize winner shall forfeit their Grand Prize and the Promoter shall be entitled to award the Grand Prize to an alternative winner in accordance with the process described above.

f. A household can only win one cash prize in the Grand Prize Promotion.

g. The cash prize will be sent within 4 weeks of verification either via cheque to the address supplied at the point of entry; via bank transfer to a UK Sterling bank account; or sent by SMS text to winner’s mobile phone that can then be used to instantly collect the cash from over 17,000 participating cash machines across the UK. i. Please note that all cash winners will be required to provide proof of full name and age with valid ID and proof of residential address before a prize can be dispatched. Proof of identity and address must match details provided at the point of entry. Business or work addresses will not be accepted. Only official documents can be accepted as proof of address (driving licence, utility bill less than three months old or bank statement, for example). Expired proof of identity or address will not be accepted. A mobile phone bill will not be accepted as proof of address.

GENERAL

9. Any unclaimed prizes, or prizes withdrawn for whatsoever reason, will be reallocated via a prize draw. Winners will be selected by a random computer generator on Monday 11th January 2021 and notified in accordance with the process set out above.

10. It is the responsibility of the entrant to provide their correct, up-to-date details when entering the Promotion and/or confirming acceptance of any prize in order for their prize to be processed. The Promoter accepts no responsibility for entrants or winners failing to supply accurate information which affects any acceptance and/or delivery of any prize.

11. No third party or bulk entries. Entries via third parties, consumer groups or syndicates, entries by macros or other automated means and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified. If it becomes apparent in the reasonable opinion of the Promoter that either an entrant or household is using any means to circumvent this condition such as, and without limitation, fraudulently falsifying data; using multiple email addresses; using multiple postal addresses; acting fraudulently or dishonestly in the reasonable opinion of the Promoter; using identities other than their own; creating fake identities or using any other automated or manual means in order to increase that participant's or a household’s entries or otherwise acting in violation of these terms, these participants and their household will be disqualified, and any prize entitlement will be void.

12. Whilst the Promoter will take all reasonable steps to ensure that its obligations relating to meeting specific timeframes for prize dispatch are met, the Promoter shall not be liable in any way for its inability to meet these timeframes resulting from an outbreak of Covid-19 either within its own business or within the prize delivery supply chain.

13. Should Covid-19 affect the Promoter’s ability to meet these deadlines, it will fulfil its obligations as soon as is reasonably possible after its and/or its third-party fulfilment providers resume business as usual.

14. The Promoter reserves the right to discount any inappropriate or offensive entries and to disqualify any entries if the Promoter, at its sole discretion, believes that there has been an attempt to manipulate or tamper with the operation of the Promotion.

15. In the event of unforeseen circumstances or circumstances outside its reasonable control, the Promoter reserves the right to modify or discontinue, temporarily or permanently, this Promotion without prior notice.

16. Entrants agree to be bound by the decisions of the Promoter, which are final in all matters relating to the Promotion. No correspondence will be entered into in respect of the Promoter’s decisions.

17. The Promoter does not accept responsibility for network, computer or software failures of any kind and has no responsibility for lost, delayed or misdirected entries.

18. Nothing in these terms excludes the Promoter’s liability for death or personal injury caused by its negligence or for fraud, or any other liability that the Promoter may not exclude by law. Subject to that, the Promoter and its associated companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits) expense or damage which is suffered or sustained in connection with this promotion or accepting or using any prize, including any loss incurred as a result of any delay and/or failure to perform any obligation to the winner or other entrants that is caused by:

a. technical problems of any kind which may limit or prevent any person's participation in the Promotion;

b. any loss or damage arising from or in connection with the allocation or enjoyment of a prize;

c. any act or omission of any third party, particularly any third party involved in the provision of services relevant to the prize; or

d. any other events beyond the Promoter's control that may cause the promotion to be disrupted or corrupted or may lead to loss of, or damage to, the winner or to the prize.

19. If any of these terms and conditions are found by a court or regulator to be invalid or unenforceable the remaining other provisions shall continue to apply.

20. The Promoter shall use entrants’ personal data for the purposes of carrying out the Promotion, and in the case of winners’ data, as set out in the Promoter’s privacy notice available at http://www.kingsmillbakery.co.uk/policy/privacy-policy and further explained in the following paragraphs.

21. Subject to the winners’ rights under applicable data protection legislation, the Promoter shall be entitled to use and feature the names of the ‘Win with Kingsmill’ prize promotion winners for publicity purposes and winners agree that they will participate in any reasonable publicity arranged by the Promoter or its agencies.

22. Data collected as part of this promotion will be retained for three months after the promotion closes (14th December 2020).

23. The Promoter will make surnames and county of residence of major prize winners (12 x Grand Prize Promotion winners and 50 x £100 Main Prize Promotion winners) available on request to anyone who sends an email here within 10 weeks of the end of the Promotion Period, as required by the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing (the “Code”). The Promoter may also be asked to provide the same details to the Advertising Standards Authority (“ASA”) who publish and enforce the Code. This use of winners’ data is necessary for the Promoter’s legitimate interests in complying with the Code. Winners who do not wish the Promoter to disclose these details to members of the public who request them, should let the Promoter know as soon as possible by emailing here. Winners may also object to the disclosure to the ASA by emailing the same address, giving reasons. The Promoter will take these reasons into account if the ASA asks for the winners’ details. Please note, however, that the Promoter may nevertheless still be required to disclose this information to the ASA. This may happen where, for example, the Promoter is required to demonstrate that a valid award took place.

24. These terms and conditions shall be governed by and construed in accordance with the laws of England and the parties agree that any dispute or action arising under or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Courts of England.
